California Pool Safety Act (Health & Safety Code 115920-115929)
California law requires all new residential swimming pools and spas built after January 1, 2007 to have at least two approved safety features. If the pool was built before 2007, at least one safety feature is required when the property changes hands or a building permit is issued.
Approved Pool Safety Features
California recognizes the following seven pool safety options:
- Pool fence or enclosure meeting ASTM F-2286 standards (most recommended)
- Approved pool safety cover meeting ASTM F-1346
- Exit alarms on doors providing direct pool access
- Self-closing, self-latching devices on doors with pool access
- Swimming pool alarm meeting ASTM F-2208
- Other means of protection deemed adequate by the local building authority
- Removable mesh pool fencing meeting ASTM F-2286 (such as Baby Barrier)
Why pool fences are the top choice: Of all seven approved options, removable pool fences provide the most reliable barrier between children and the water. Unlike alarms that only alert after a child enters the pool area, a fence prevents access entirely.
ASTM F-2286-05 Standard Requirements
The ASTM F-2286-05 standard establishes the minimum performance requirements for removable pool fences. All Baby Barrier installations meet or exceed these standards:
- Minimum height: 4 feet (48 inches) from the ground to the top of the fence
- Mesh openings: Small enough to prevent a child from climbing through (no larger than 1.75 inches)
- Gate requirements: Self-closing and self-latching, opening outward (away from the pool)
- Structural integrity: Must withstand specified force loads without failure
- No climbable features: Fence design must not provide handholds or footholds
- Ground clearance: Maximum gap between the bottom of the fence and the ground
Local Building Code Requirements
In addition to state law, California counties and cities may have their own pool barrier requirements. Common local additions include:
- Permit requirements for pool fence installation
- Inspection before pool use is authorized
- Specific setback distances from the pool edge
- Requirements for pools near property lines
Contra Costa County
Covering Danville, San Ramon, Walnut Creek, Lafayette, Orinda, Alamo, and Blackhawk, Contra Costa County enforces California Building Code Section 3109. Alameda County
Serving Pleasanton, Dublin, and Livermore, Alameda County follows the same California Building Code with its own inspection requirements. New construction pools must have approved barriers before occupancy.
When Is a Pool Fence Required?
- New pool construction: Two safety features required since 2007
- Property sale: Seller must disclose pool safety feature status; buyer may need to add features
- Remodel or building permit: May trigger requirement for additional safety features
- Insurance requirements: Many homeowners insurance policies require pool barriers regardless of code
